The AJC reports as of 9:43 AM today in Gwinnett county alone the police have worked about 174 traffic accidents since midnight. I have written before about liability for auto accidents in Georgia in snow and ice conditions like we are experiencing today. Under Georgia law at O.C.G.A. Section 40-6-180,
"No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard for the actual and potential hazards then existing. Consistently with the foregoing, every person shall drive at a reasonable and prudent speed when approaching and crossing an intersection or railroad grade crossing, when approaching and going around a curve, when approaching and traversing a hill crest, when traveling upon any narrow or winding roadway, and when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway conditions" (emphasis supplied).
In other words, when a driver in Georgia loses control of his vehicle on snow or ice, the law holds him responsible for any resulting accident. If the only safe speed to avoid losing control is zero, then it is a violation of O.C.G.A. Section 40-6-180 to drive.
Today Georgia state and local officials are advising motorists to stay inside and off the roads. Several roads around metro Atlanta are closed. Please follow their advice and stay safe. Georgia drivers and generally inexperienced in driving in these conditions and are roadways are not cleared during these weather events to the extent roads are cleared in northern states.
