Non COVID-19 Nursing Home Neglect Increasing During Pandemic — The Armond Firm, LLC

It goes without saying that nursing homes should be places where the elderly and disabled, at a bare minimum, receive proper medical care and humane treatment. In the current pandemic anyone with a loved one in a nursing home has the obviously great concern of COVID-19. However, a recent Associated Press story demonstrates that there are additional risks for nursing home patients during this time:  overburdened staff resulting in neglect and mental health decline resulting in failure to thrive.

The article points out that nursing homes are experiencing excess deaths beyond those caused by COVID-19. The Georgia COVID-19 Pandemic Business Safety Act became effective in Georgia this past summer. The act limits liability for nursing homes for COVID-19 liability claims. However, with the increase in nursing home neglect that is caused by understaffing during the pandemic, the act arguably will not limit liability for those claims.
