Products Liability: Fisher-Price Rock n' Play Sleeper — The Armond Firm, LLC

According to the United States Consumer Product Safety Commission, Fisher-Price, a subsidiary of Mattel, has issued a recall for all models of the Fisher-Price Rock n' Play Sleeper. The Consumer Products Safety Commission recall page for the Fisher-Price Rock n' Play Sleeper indicates 30 infant fatalities have occurred in the product. The recall involves 4.7 million units. The manufacturer of any personal property sold as new property directly or through a dealer or any other person shall be liable in tort, irrespective of privity, to any natural person who may use, consume, or reasonably be affected by the property and who suffers injury to his person or property because the property when sold by the manufacturer was not merchantable and reasonably suited to the use intended, and its condition when sold is the proximate cause of the injury sustained.

In other words, the manufacturer of a product which proximately causes personal injury or wrongful death to any person in Georgia can be sued for damages.
